Sktcabs platforms ( website , mobile application ) - Terms and Conditions

1. Acceptance of Terms :-

*By using skt platforms ("the Skt website , mobile application "), you agree to comply with and be bound

by these Terms and Conditions. If you do not agree to these terms, please do not use the Skt platforms .

2. Definitions :-

*"User" refers to any person or entity using the Skt platforms ( Age 18+ )

*"Driver" refers to individuals/cab owner provides cab rental/booking services through the Skt platforms .

*"Services" refers to cab rental / booking services provided by the Skt platforms .

3. Registration and User Accounts :-

*Users must register an account to access certain features of the Skt platforms .

*Users are responsible for maintaining the security of their account information( passwords) .

*Users must provide accurate and up-to-date information during registration.

4. Cab Booking :-

*Users can book cab rental services provided by various drivers through the Skt platforms .

*Service details, including pricing, are provided by the drivers and may vary.

*User can pay the service amount directly to the driver either by cash or via online mode according to

driver payment conditions associated with that cab service.

*Users agree to abide by the specific cancellation policies of skt platforms .

5.Platform fee and taxes :-

* skt platform charge a platform fee of ₹20 + 18% GST in advance on every booking made by user .* skt platforms on behalf of central and state government charges 5% GST on cab fare amount . This GST

tax amount will be taken from user in advance while user made a booking through skt payment gateway .

6. Cancellation policy :-

We levy the following cancellation charge on be half of our skt driver

* 5% as a cancellation amount of booking amount is provided to driver on every cancellation by user .

* if cab arrive at your doorstep and you return , you have to pay 50% cancellation charge to the selected driver on the spot .

7. Refund policy :-

* In case driver cancelled the booking, the platform fee with GST and GST taken on cab fare will be refunded within 24hrs .

* In case user cancelled the booking , Platform fee with GST will not be refunded and the 5%GST taken on cab fare will be provided to driver as a cancellation fee .

*compensation will be provided to the customer when our team satisfied that due to service failure customer suffer a loss and this service failure is willfully omitted by driver .

* 1st we allow the driver and the user / customer to communicate with each other regarding the compensation amount but if the negotiation fails then the decision of skt management will be final and acceptable to both driver and user.

* If the cab/service breakdown in between the journey/trip , the user has to pay only the amount he has used for the service till the time the cab/service breaks down rest amount will be refunded .

8. Driver Relationships :-

*Skt acts as an intermediary, connecting users with drivers.

*skt is responsible for the quality, safety, or legality of driver services within a limit .

*Users are encouraged to review driver ratings and reviews before booking.

9. User Responsibilities

*Users must treat drivers with respect and courtesy.

*Users agree not to engage in fraudulent or illegal activities on the Skt platforms .*Users are responsible for any content/review/testimonial they post on the Skt platforms .

*If after using the service the user intentionally refuses to give payment to the selected skt driver then the skt skt platforms or the selected skt driver has the right to take strict action against such user.

*If during the journey the user tries to tamper with the driver’s vehicle/asset/property, then strict action will be taken against such user and he will also be fined.

10. Liability and Disclaimers :-

*The Company shall, in no circumstances whatsoever be liable to the client or any person travelling with him or her for: Any death, personal injury, sickness accidents, loss delay, discomfort, increased expenses, consequential loss and / or damage or theft howsoever caused.

*However skt management try their best to resolve the dispute and allow user and driver to first negotiate on their own but if negotiation fail than in this situation skt management decision is final .

*Users agree to use the Skt platforms and its services at their own risk.

*The skt platforms /company does not own or control cabs as these service provided by the driver. As an operator of the skt platforms / company , we cannot be held liable to these type of third party services ; but the company try their best to resolve the problem .

* Where there has been no fault on the part of the driver.

* Where the failure in performance of the contract are attributable to the customer .

* Where the failure are attributable to a third party not connected with the provision of the company or driver and is unforeseeable or unavoidable .

* Where the failure are due to unusual and unforeseeable circumstances beyond your and driver control .

* Where the failures are due to an event which you or your driver even with all due care could not foresee or foretell.

*Skt disagree the liability of any act, omission, default of any independent contractor or other person or by any servant or agents employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for the client or for any person travelling with him howsoever caused.

*skt platforms / company are unable to take liability for commercial arrangements out of our control such as natural disasters, COVID19, driver disputes, reason of threat or war, riots, civil strife, terrorist activities, technical problems to the , extreme weather conditions, closure of the airports and sea ports and similar event out of our control, or are due to unusual and unforeseeable circumstances beyond our control.

11. Privacy and Data Handling :- skt collects and handles user data as described in the Privacy Policy.

Users are encouraged to review the Privacy Policy for details.

12. Reviews and Ratings :-

Users can provide reviews and ratings of drivers.

Skt may moderate reviews and remove inappropriate content.

13. Termination and Suspension :-

Skt reserves the right to terminate or suspend user accounts for violations of these Terms and Conditions.

14. Governing Law and Jurisdiction :-

These Terms and Conditions are governed by the laws of uttarpradesh india jurisdiction

Any legal disputes will be resolved in the courts of delhi ncr region .

15. Changes to Terms and Conditions :-

Skt may update these Terms and Conditions as needed.

Users will be notified of any changes, and continued use of the Skt platforms constitutes acceptance of the revised terms.
